 Abstract 

Background. The institute of property rights has been and remains in the spotlight for the society and the state throughout history. The modern civil and legal regulation of the institute of property rights is the product of a long evolution of the Russian legal system and legislation governing legal relations that develop over property. The article aims at providing a legal analysis of the institute of property rights, identifying the features of property legislation at each stage of its development. Materials and methods. The tasks are accomplished through analyzing the main sources of both pre-revolutionary and Soviet civil law. The methodological potential includes the methods of comparative legal and historical legal analysis, which allow comparing the order of legal regulation of property relations in different periods of its development. Results. The formation and development of the institute of property rights in the Russian civil law in the period from the origin of the Old Russian state to the 20th century are studied. The prerequisites for the emergence and the peculiarities of the legislative consolidation of the institute in question at different stages of the country’s development are analyzed, which enable identifying new approaches to their theoretical understanding. Conclusions. The study of the development of the institute of property rights makes it clear that the legislative consolidation of property rights in Russia has passed a fairly long period, starting from the awareness of the very concept of "property". At the same time, it should be noted that the institute of property rights is complex, its norms are found in various branches of law, such as land law, family law and housing law. The institutions and provisions formulated in civil law of modern Russia are the result of the historical development in the country and the accumulated experience in designing ownership relations among subjects of civil law. The findings can be useful for further reform of this legal institute, which may result in significant changes in both economic and legal spheres.
